Misleading
–
The misleading offence sanctions the fact that any person, whether or not a party to the contract, misleads a contracting party by any means or procedure, even through the intermediary of a third party. The offence may be committed in relations between professionals and consumers, but also between private individuals or between professionals, and concerns elements of a product such as its nature, type, origin, substantial qualities, composition, quantity, suitability for use, etc. (Article L441-1 of the Consumer Code).
Misleading commercial practice
–

This is the misuse of an indication of origin or provenance likely to mislead the consumer about the characteristics of the product, to misappropriate or diminish the reputation of a name recognised as a designation of origin or registered as a geographical indication or as a traditional speciality guaranteed (Article L643-2 of the Rural and Maritime Fishing Code)
Mutual recognition

This principle applies in the context of the free movement of goods. Where there are no harmonised rules at EU level, any product legally sold in one EU country can be sold in another, even if it does not comply with all its technical rules (except in strictly defined circumstances).
